This website is operated by Red Lobster Gallery. Throughout the site, the terms "we", "us" and "our" refer to Red Lobster Gallery. Red Lobster Gallery offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.
Your statutory rights - Nothing in these Terms of Service affects your legal rights as a consumer. If anything in these Terms conflicts with your rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other consumer protection legislation, your statutory rights take precedence and this document should be read accordingly.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or that you are aged 18 or over and have given your consent for a minor dependent to use this site under your supervision.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms may result in the termination of your access to our Services.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse service to anyone at any time, provided that we will never refuse service on any ground that would amount to unlawful discrimination under the Equality Act 2010.
You understand that your content (not including card payment information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Card payment information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.
SECTION 4 - HOW A CONTRACT IS FORMED BETWEEN US
4.1 Placing an order on our website is an offer to buy. It does not create a binding contract.
4.2 The order confirmation email you receive immediately after checkout is an acknowledgement that we have received your order. It is not an acceptance of it.
4.3 A contract between us is formed only when we dispatch the goods to you, or — for Click & Collect orders — when we notify you that your order is ready to collect. At that point we will send you a dispatch or collection confirmation.
4.4 Many of the pieces we sell are original works, limited editions or single items shared between our website and our shop floor in Sheringham. Occasionally an item may sell in store between the time you place your order and the time we come to dispatch it. If we are unable to fulfil your order for this or any other reason, we will contact you as soon as possible and refund any payment taken in full, within 14 days. Our liability in these circumstances is limited to that refund.
4.5 If an item is listed at an obviously incorrect price and the error is one you could reasonably have recognised as a mispricing, we are not obliged to supply it at that price. We will contact you before dispatch to offer you the option of buying at the correct price or cancelling for a full refund.
SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. Any change in price will not affect an order where a contract has already been formed under Section 4.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service, save that nothing in this section limits our liability under Section 19.
SECTION 6 - PRODUCTS, HANDMADE VARIATION AND DESCRIPTIONS
Certain products or Services may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only in accordance with our Refund and Returns Policy and Section 8 of these Terms.
6.1 Handmade and hand-finished pieces. Many of the pieces we sell — including ceramics, cast brass and bronze, glassware, and hand-finished prints — are made individually by hand or in small batches. Small variations in colour, glaze, patina, finish, texture, grain, weight and dimension are inherent characteristics of handmade work and form part of the description of the goods. No two pieces are identical, and the piece you receive may differ slightly from the photographs shown. Variation of this kind is a feature of the work and is not a fault.
6.2 Screen display. We have made every effort to display the colours and images of our products as accurately as possible. Screen calibration varies between devices and we cannot guarantee that your monitor, tablet or phone will display colours accurately.
6.3 Nothing in sections 6.1 or 6.2 affects your statutory right to receive goods that are of satisfactory quality, fit for purpose and as described.
We reserve the right, but are not obliged, to limit the sales of our products or Services to any person, geographic region or jurisdiction, and to limit the quantities of any products we offer. We reserve the right to discontinue any product at any time.
SECTION 7 - DELIVERY, COLLECTION AND RISK
7.1 We will deliver your order within the timescales set out on our Delivery & Returns page. Unless we have agreed a different timescale with you, we will deliver within 30 days of the contract being formed.
7.2 Goods remain at our risk until they come into your physical possession, or into the possession of a person you have identified to take delivery of them. Where you have arranged your own carrier, risk passes to you when we hand the goods to that carrier.
7.3 Click & Collect orders placed through our website are distance contracts. Your right to cancel under Section 8 applies to them in the same way as to delivered orders.
7.4 Delivery charges are calculated at checkout and shown to you in full before you pay. We do not add any mandatory charges after that point.
SECTION 8 - YOUR RIGHT TO CANCEL
This section applies if you are a consumer buying from our website. It does not apply to purchases made in person at our shop, or to business customers.
8.1 Your 14-day right to change your mind. You have the right to cancel your order within 14 days of the day on which you (or someone you have nominated) receive the goods. Where an order is delivered in more than one consignment, the 14 days runs from the day you receive the last item.
8.2 How to cancel. To cancel, simply tell us clearly before the 14 days is up. The easiest ways are:

You may use the model cancellation form set out at the end of these Terms if you wish, but you do not have to — an email or a phone call is enough. What matters is that you make a clear statement that you are cancelling.
8.3 Returning the goods. You must send the goods back to us within 14 days of telling us you are cancelling. Unless the goods are faulty, incorrectly supplied or damaged in transit, you are responsible for the cost of return postage. Please obtain proof of postage. We strongly recommend insuring the return of higher-value items, as you are responsible for them until they reach us.
8.4 Your refund. We will refund you within 14 days of receiving the goods back, or within 14 days of you providing evidence that you have sent them, whichever is earlier.
We may reduce your refund to reflect any reduction in the value of the goods caused by you handling them more than was necessary to establish their nature, characteristics and functioning — that is, more than you would have been able to handle them in our shop. Hanging, mounting, installing or displaying a piece goes beyond this.
8.5 Commissions and Personalised Items.
Your right to cancel does not apply to goods that are made to your specification or are clearly personalised. This includes commissioned artwork, pieces made to order for you, items that have been engraved or personalised at your request, and frames made to dimensions you have supplied.
Choosing between options we already offer — for example selecting a frame colour or a size from a drop-down menu — does not make an item personalised, and your right to cancel applies to those orders in the usual way.
Where you place a commission, we will make clear in writing before you commit that the piece is exempt from the 14-day cancellation right, and we will agree the specification, price and timescale with you at that point.
All other items, including original artwork, limited editions and reduced-price or clearance items, carry the full right to cancel set out in sections 8.1 to 8.4.
SECTION 9 - FAULTY, MISDESCRIBED OR DAMAGED GOODS
9.1 Your statutory rights. Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you have the right to reject them and receive a full refund within 30 days of receiving them. After 30 days, you are entitled to a repair or replacement, and if that is unsuccessful, to a refund or a price reduction. These rights apply to all goods, including reduced-price, clearance and commissioned items, and cannot be excluded.
9.2 Damaged in transit. Please check your order on arrival. If anything has been damaged in transit, contact us at hello@redlobstergallery.co.uk or on 01263 825590 as soon as you can — within 7 days — and please keep the item together with all of its original packaging, including the outer box, until the matter is resolved.
So that we can put things right quickly and make a claim against the carrier, please send us photographs showing:
- the damage to the item;
- the item alongside the packaging it arrived in;
- the outer box, including any damage to it; and
- the shipping label, clearly readable.
This is a request to help us resolve your claim faster. It is not a condition of your statutory rights, and contacting us after 7 days does not affect them.
9.3 How we will put it right. In most cases we will simply send you a replacement, or refund you if you would prefer, without asking you to return the damaged item. Where the item is of higher value, or where we need to inspect it, we will ask you to return it and we will arrange and pay for that — normally by sending you a prepaid postage label. You will never be asked to pay to return faulty, damaged or incorrectly supplied goods.
9.4 Where a replacement is not possible. Many of our pieces are original works or limited editions and a direct replacement may not exist. In that case we will offer you a full refund, or an alternative piece of equivalent value if you would prefer.
SECTION 10 - PAYMENT, AND BUY NOW PAY LATER
10.1 We accept the payment methods shown at checkout, currently including Visa, Mastercard, Maestro, PayPal, Apple Pay, Google Pay, Shop Pay and Klarna.
10.2 Where you choose to pay using a "buy now, pay later" or instalment option provided by a third party such as Klarna, you enter into a separate credit agreement with that provider. We are not the lender and we are not a party to that agreement. The provider’s own terms, eligibility criteria and affordability checks apply, and you should read them before proceeding.
10.3 Deferred payment credit of this kind has been regulated by the Financial Conduct Authority since 15 July 2026. Any complaint about the credit agreement itself — including affordability, payment schedules, missed payment charges or credit reporting — should be raised with the provider, who is required to operate a complaints process and may be subject to referral to the Financial Ombudsman Service.
10.4 Where you cancel an order or return goods paid for using an instalment provider, we will process the refund to that provider, who will then adjust or settle your credit agreement in accordance with its terms.
SECTION 11 - INTELLECTUAL PROPERTY IN ARTWORK
11.1 When you buy a piece of artwork, a print, a sculpture or any other item from us, you acquire ownership of that physical item only.
11.2 Copyright and all other intellectual property rights in the underlying work remain with the artist or other rights holder. Buying a piece does not transfer any copyright to you and does not give you any right to reproduce, copy, scan, photograph for commercial purposes, publish, adapt, licence or make derivative works from it.
11.3 We are not able to grant reproduction or licensing rights on an artist’s behalf. If you wish to reproduce a work, please contact us and we will pass your request to the artist.
11.4 Photographing a piece you own for personal, non-commercial purposes — for example sharing a photograph of it in your home on social media — is fine and welcomed.
11.5 All content on this website, including photographs, product descriptions, artwork images, the Red Lobster Gallery name and logo, and the design of the site itself, is protected by copyright and trade mark rights and may not be reproduced without our written permission.
SECTION 12 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment card, and/or orders that use the same billing and/or delivery address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email address and/or billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to update your account information promptly so that we can complete your transactions and contact you as needed.
Where we cancel an order you have already paid for, we will refund you in full within 14 days.
SECTION 13 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website. Such new features and/or Services shall also be subject to these Terms of Service.
SECTION 14 - THIRD-PARTY LINKS
Certain content, products and Services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites.
Please review carefully the third party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
SECTION 15 - USER COMMENTS, REVIEWS, FEEDBACK AND OTHER SUBMISSIONS
If, at our request, you send certain specific submissions (for example competition entries) or, without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right, and will not contain unlawful, abusive or obscene material, or any computer virus or other malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments.
Reviews. We publish customer reviews as they are received. We do not write, commission or incentivise fake reviews, and we do not remove or suppress genuine reviews because they are unfavourable. Where a review has been submitted by someone who received a product free of charge, a discount or any other incentive, that will be disclosed alongside the review. Reviews may be moderated only to remove unlawful, offensive or off-topic content, or content that identifies a third party.
SECTION 16 - PERSONAL INFORMATION

SECTION 17 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice (including after you have submitted your order).
Where we cancel an order under this section, we will refund you in full within 14 days. This does not affect your statutory rights.
SECTION 18 - PROHIBITED USES
In addition to other prohibitions set out in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international or UK regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate on the basis of any protected characteristic; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
SECTION 19 - LIMITATION OF LIABILITY
19.1 Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the terms implied by sections 9 to 11 and 13 to 16 of the Consumer Rights Act 2015; defective products under the Consumer Protection Act 1987; or any other liability which cannot lawfully be excluded or limited.
19.2 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach. We are not responsible for loss or damage that is not foreseeable.
19.3 We do not guarantee that the website will always be available or be uninterrupted, and we may suspend, withdraw or restrict availability of all or part of it for business or operational reasons. We will give you reasonable notice where we can.
19.4 We supply our products for domestic and private use. If you use the products for any commercial or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
19.5 Where you are a business customer, our total liability to you in respect of any order shall not exceed the price paid for the goods under that order.
SECTION 20 - INDEMNIFICATION (BUSINESS CUSTOMERS ONLY)
20.1 This section applies only to customers purchasing in the course of a business. It does not apply to consumers.
You agree to indemnify, defend and hold harmless Red Lobster Gallery and our officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
SECTION 21 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 22 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If you fail to comply with any term or provision of these Terms of Service, we may terminate this agreement and deny you access to our Services. You will remain liable for all amounts due up to and including the date of termination. This does not affect any rights you have in respect of goods already purchased.
SECTION 23 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 24 - COMPLAINTS
24.1 If something has gone wrong, please tell us. Email hello@redlobstergallery.co.uk, call 01263 825590, or write to Red Lobster Gallery, 25 Station Road, Sheringham, Norfolk, NR26 8RF.
24.2 We will acknowledge your complaint within 7x working days and aim to resolve it within 14x working days. If we need longer, we will tell you why and keep you updated.
24.3 If we cannot resolve your complaint between us, you may be able to refer it to an alternative dispute resolution provider or to your local Trading Standards service via the Citizens Advice consumer helpline. This does not affect your right to bring a claim in the courts.
SECTION 25 - GOVERNING LAW
These Terms of Service, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in the courts of the country in which you live. If you are a consumer resident outside the United Kingdom, you retain the benefit of any mandatory consumer protection provisions of the law of the country in which you are resident.
SECTION 26 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
Any change to these Terms will apply to orders placed after the change is published. It will not apply retrospectively to a contract already formed under Section 4.
